Who determines guilt or innocence?


In a trial without a jury, the judge decides guilt or innocence.  In a trial by jury, the jury decides. Our job is to present our findings, evidence, or lack a thereof, to the defense attorney and he/she will make the decision to make a motion to admit the evidence.  From there, the judge or jury will decide how much credibility the evidence has in proving the defendant committed the crime he/she is being held for. 

Homicide crimes we do not investigate

Unfortunately, we do not assist in any criminal defense matter involving the murder of a police officer, detective, or investigator.

By searching for defects in the investigation process, private investigators ensure the criminal investigation performed fairly and impartially. 

How much will your services cost?

Hopefully, you are more worried about quality rather than price considering someone’s liberty is at stake. Price is one time and cost is all the time. Our prices vary based on our current operations. 

For those without means or funding, California Penal Code §987.2 allows the accused to employ a criminal defense investigator at the court’s discretion. We do accept these types of appointments; however you or your attorney must petition the court to employ our services.

Effective February 5, 2014, Sundahl & Associates does not provide homicide defense testimony anymore. However, if you have any questions about a homicide investigation, protocol, or you need an interview done, we can help you. Consultations are free. Call or email us immediately.

Sundahl & Associates has investigators on our staff with a law enforcement background of placing many people in prison and death row for homicide crimes such as murder and manslaughter.  We have assisted many criminal prosecutors in the District Attorneys’ offices of Riverside County, San Bernardino County, and Los Angeles County. Fortunately, we changed sides and will work with your defense attorney in recovering exculpating evidence (evidence to disprove a fact).


Burden of Proof


The prosecutor has the burden of proving beyond a reasonable doubt, the defendant committed the crime in question.  The definition of what constitutes “reasonable doubt” appears to change from time to time. Currently, many courts agree proving beyond a reasonable doubt, does not mean there is no doubt the defendant committed the crime. It means a reasonable and prudent person would agree based on the evidence, that the defendant committed the crime.   

Our job as private investigators, is to find that particular piece of evidence (eyewitness, records, DNA, etc..) that helps contradict the evidence used against the defendant. For example, homicide detectives may locate an eyewitness who saw the defendant “pull the trigger.” The private investigator might locate someone who can testify to observing the “eyewitness” in a location where he there was no reasonable way the eyewitness could have observed the “trigger man.”  Here, if the jury believes the new witness the private investigators located, then the jury will give less credibility to the eyewitness’ testimony. 

Why do we perform murder defense investigations?


Would you agree every person accused of murder should have a right to a fair trial? Isn’t a fair and public trial a distinguishing characteristic of a country that prides itself on freedom? In fact, the framers of the U.S. Constitution created the Sixth Amendment. The Sixth Amendment allows every man or woman accused of a crime, the right to an adequate defense. The duty we are referring to is the guardian of the rights afforded by the U.S. Constitution.
